Please read these Terms of Use ("Terms") carefully before using the EliteFace AI mobile application (the "App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using EliteFace AI, you confirm that:

1. You are at least 13 years of age (or the minimum age of digital consent in your jurisdiction).
2. If you are under 18 (or the legal age of majority in your jurisdiction), you have obtained the consent of a parent or legal guardian.
3. You agree to comply with these Terms and all applicable laws and regulations.

2. Description of the Service

EliteFace AI is a facial analysis application that uses your device's camera and Apple's on-device machine learning frameworks (Vision, ARKit, Core Image) to provide:

• Facial Attractiveness Analysis: Scores across categories including symmetry, skin health, golden ratio proportions, jawline definition, and eye appeal.
• Face Shape Detection: Classification of your face shape (oval, round, square, heart, diamond, oblong).
• Skin Age Estimation: An estimated skin age based on skin health metrics.
• Celebrity Lookalike Matching: Comparison of your facial proportions against a local database of celebrity templates.
• Personalized Recommendations: Suggestions for skincare, facial exercises, and improvement tips.
• Progress Tracking: History of your scans over time.
• Before & After Comparison: Side-by-side comparison of past and current scans.
• Pro 3D Scan: Detailed facial geometry analysis using the TrueDepth camera system (on supported devices).
• Share Results: Generate shareable images of your analysis results.

3. Important Disclaimers

3.1 Entertainment and Informational Purposes Only

• The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.
• Facial analysis scores, skin age estimates, and all other results are generated using algorithmic analysis and should not be considered medical advice, professional dermatological assessment, or a measure of personal self-worth.
• The App does not perform biometric identification or facial recognition for security purposes.
• Celebrity lookalike matching is based on mathematical facial proportion comparisons and is provided purely for entertainment.

3.2 No Medical Advice

The recommendations and suggestions provided by the App (including skincare tips, facial exercises, and lifestyle advice) are general in nature and are not a substitute for professional medical advice. Always consult a qualified healthcare professional before making changes to your skincare routine or health practices.

3.3 Accuracy

While we strive to provide accurate and meaningful analysis using Apple's advanced on-device frameworks, results may vary based on:

• Lighting conditions during photo capture
• Photo quality and camera angle
• Device capabilities (TrueDepth availability varies by model)
• Natural facial variations throughout the day

We do not guarantee the accuracy, completeness, or reliability of any analysis results.

4. Subscriptions and Payments

4.1 Free Features

The App provides limited free scans. After the free scan allowance is used, a premium subscription is required to access additional features.

4.2 Premium Subscription

• Subscription Plan: EliteFace AI offers a weekly auto-renewable subscription ("EliteFace Premium").
• Pricing: The current subscription price is displayed on the paywall screen within the App, and is confirmed at the time of purchase through Apple's payment system.
• Payment: Payment is charged to your Apple ID account at confirmation of purchase.

4.3 Auto-Renewal

• Your subscription will automatically renew each week unless you cancel it at least 24 hours before the end of the current billing period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• The renewal price will be the same as the original subscription price unless we notify you of a price change in advance.

4.4 Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time through:

• iPhone/iPad: Settings → [Your Name] → Subscriptions → EliteFace AI
• App Store: Open the App Store → tap your profile → Subscriptions → EliteFace AI
• Online: https://apps.apple.com/account/subscriptions

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid subscription period. No refunds are provided for any unused portion of a subscription period.

4.5 Restoring Purchases

If you reinstall the App or switch devices, you can restore your active subscription by tapping "Restore Purchases" on the paywall screen. This verifies your subscription status with Apple's App Store.

4.6 Free Trial

If a free trial is offered, it will be clearly stated on the paywall screen. Any unused portion of a free trial period is forfeited when you purchase a subscription. At the end of the free trial, your subscription will begin and your Apple ID account will be charged unless you cancel at least 24 hours before the trial ends.

4.7 Price Changes

We reserve the right to change subscription prices. Any price change will take effect at the start of the next subscription period following the date of the price change. Apple will notify you in advance of any price change, and you will have the opportunity to cancel before the new price takes effect.

5. Intellectual Property

5.1 Ownership

EliteFace AI, including all content, features, functionality, design, code, algorithms, trademarks, and other intellectual property, is owned by EliteFace AI and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and the Apple Media Services Terms and Conditions.

5.3 Restrictions

You agree not to:

• Copy, modify, distribute, sell, or sublicense the App or any part of it.
• Reverse engineer, decompile, or disassemble the App.
• Use the App for any commercial purpose without our prior written consent.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Use automated means (bots, scrapers, etc.) to interact with the App.
• Use the App to harass, abuse, or harm others.
• Attempt to gain unauthorized access to the App's systems or data.

6. User Conduct

You agree to use the App responsibly and in compliance with all applicable laws. Specifically, you agree not to:

• Use the App to analyze photos of others without their consent.
• Use analysis results to harass, bully, or discriminate against any person.
• Upload or submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Use the App in any way that could damage, disable, or impair its functionality.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key highlights:

• All data processing occurs on your device.
• No photos or facial data are uploaded to any server.
• No third-party analytics or tracking SDKs are used.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
• WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY ANALYSIS RESULTS, SCORES, RECOMMENDATIONS, OR OTHER CONTENT PROVIDED BY THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL ELITEFACE AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
• IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
• THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless EliteFace AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any content you submit through or share from the App.

11. Third-Party Services

11.1 Apple

The App is distributed through Apple's App Store, and your use of the App is also subject to Apple's Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to Apple-specific matters.

11.2 User-Initiated Sharing

When you share your analysis results through the system share sheet, the shared content is processed by the platform you choose to share to (e.g., Instagram, Messages, WhatsApp). Your use of those third-party platforms is governed by their respective terms and privacy policies.

12. Apple End-User License Agreement (EULA) Compliance

The following terms apply as required by Apple's App Store guidelines:

1. Licensed Application: This license is granted to you for use of the EliteFace AI app ("Licensed Application") and is subject to the Apple Media Services Terms and Conditions.
2. Scope of License: The Licensor grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Maintenance and Support: The Licensor is solely responsible for providing maintenance and support services for the Licensed Application. Apple has no obligation to provide any maintenance or support services with respect to the Licensed Application.
4. Warranty: The Licensor is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Licensed Application.
5. Product Claims: The Licensor, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Claims: In the event of any third-party claim that the Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Legal Compliance: You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Termination

13.1 By You

You may stop using the App and delete it from your device at any time. Deleting the App will remove all locally stored data.

13.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections 3, 5, 8, 9, 10, and 14 of these Terms shall survive termination.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EliteFace AI operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and EliteFace AI regarding your use of the App, and supersede all prior agreements and understandings.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, through an in-app notification. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
